CRIMINAL DEFENSE

We defend California residents accused of a number of crimes, including serious felonies, homicides, domestic violence, child abuse, restraining orders, drug offenses, fraud, assault and battery, other violent crimes, and business-related criminal offenses. We also have expertise in criminal sentencing procedures, mitigation, and expungements.

Dismissal of criminal charges against a commercial fisherman after a four-day jury trial. We showed that our client, the defendant, had been falsely accused of stealing commercial fishing gear. Defendant’s accusers, who were business competitors, improperly abused the process of the legal system to exact revenge against our client, who had informed law enforcement of the accusers’ illegal fishing activities.

Dismissal of criminal charges after proving that a search warrant was not valid. We represented a young man whose home had been searched, leading to our client’s arrest for possession of marijuana and firearms. We were able to get the case dismissed after we investigated and proved that the search warrant was not valid.

Substantial reduction in murder charges after a passenger died in auto accident. We defended the driver in a tragic alcohol-related auto accident in which a passenger died. Initially our client, who was driving without a license and had a past gang history, was charged with murder. Sax managed to get the charges substantially reduced due to extenuating circumstances after making a thorough investigation.

Successfully fought to keep Native American teenager out of San Quentin. The family of a quiet, sensitive Native American teenager asked us to help him when he was charged with assault with a deadly weapon, for being in the vicinity of a fight in which another teenager was killed by a large rock. Our client did not take part in the fight, and was unfairly accused of being a gang member. We were able to keep him in the juvenile system, and he served his sentence in a rehabilitation facility in Northern California. He has since turned his life around.

Dismissal after a successful defense of a disabled client charged with making felony terrorist threats. We were hired by a family to defend a young disabled man who was charged with making felony terrorist threats. After a thorough investigation, we were able to prove that the charges were unfounded, causing the district attorney to dismiss the charges.

Successfully obtained a reduction in sentence for a devastated teenager who was accused of the death of a young woman. We represented a devastated 18-year-old on probation, who caused the death of a young woman while driving under the influence. Result: the young man was sentenced to several months in Juvenile Hall.

Successfully influenced client to rehabilitate during court proceedings. We defended an individual with an extensive criminal history for a felony DUI that resulted in injuries to a passenger. Sax persuaded the individual to enter into counseling and take charge of his substance abuse problems prior to his sentencing.

Effective defense of a client who was charged with assault with a deadly weapon. We mounted an effective defense of a client charged with assault with a deadly weapon, a 20-pound rock, which hit the head of a bystander, causing serious injuries.

Dismissal of a case in which a 14-year-old was charged with threatening to kill his mother.

Dismissal of a case in which our client was pulled over by the Marin County Police Department for no reason.
